1. Acceptance of Terms

Welcome to CamperClick. These Terms and Conditions ("Terms") constitute a legally binding agreement between you and CamperClick ("we," "our," or "us") governing your use of our platform and services. By accessing or using CamperClick, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use our services. We reserve the right to modify these Terms at any time, and your continued use of the platform following any changes constitutes acceptance of those changes.

2. Description of Services

CamperClick is a booking platform that connects users with camping properties, RV parks, and related accommodations ("Properties"). We provide a technology platform that facilitates reservations between users and Properties. CamperClick acts as an intermediary and is not a party to the actual booking agreement between you and the Property.

3. User Accounts

3.1 Account Creation

To use certain features of our platform, you must create an account. You may register directly or through third-party authentication services such as Google. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Automatic Account Creation

If you make a booking through CamperClick or book with a Property using CamperClick without first creating an account, an account will be automatically created for you using the information you provide during the booking process (such as your name, email address, and phone number).

This automatic account creation is necessary to:

• Ensure the security and protection of your personal information
• Allow you to manage your bookings and reservations
• Provide you with access to booking history and receipts
• Enable secure communication between you, CamperClick, and Properties
• Facilitate any refunds, modifications, or customer support needs

By completing a booking, you consent to the automatic creation of an account and agree to these Terms. You will receive an email with instructions on how to set a password and access your account. If you created an account through third-party authentication, you can continue to access it using that method.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.4 Account Requirements

You must be at least 18 years old to create an account and use our services. By creating an account, you represent and warrant that you meet this age requirement.

4. Information Sharing and Privacy

4.1 Consent to Share Information

By using CamperClick and making bookings through our platform, you explicitly agree that your personal information, including but not limited to your full name, email address, phone number, and time zone, will be shared with the Properties you book with or inquire about.

This information sharing is essential for Properties to provide you with their services, communicate with you about your reservation, and fulfill your booking.

4.2 Third-Party Data Collection

When you authenticate using third-party services (such as Google), we collect personal information from those services as permitted by their terms and privacy policies. You acknowledge and agree to this collection and use of your information.

4.3 Privacy Policy

Our collection, use, and sharing of your personal information is further described in our Privacy Policy, which is incorporated into these Terms by reference.

5. Bookings and Reservations

5.1 Booking Process

When you make a booking through CamperClick, you are entering into a direct contractual relationship with the Property. CamperClick facilitates the booking but is not a party to the transaction between you and the Property.

5.2 Payment

Payment for bookings is processed through our platform. By providing payment information, you authorize us to charge the applicable fees for your reservation. All payments are subject to our refund policy and the Property's cancellation policy.

5.3 Cancellations and Refunds

Cancellation and refund policies are determined by each individual Property and will be displayed at the time of booking. You agree to review and accept the applicable cancellation policy before completing your reservation. CamperClick is not responsible for enforcing or modifying Property cancellation policies.

5.4 Booking Modifications

Any modifications to your booking, including date changes or cancellations, must be made through CamperClick or in accordance with the Property's policies. Modifications are subject to availability and may incur additional fees.

6. Disputes with Properties

6.1 Property Responsibility

You acknowledge and agree that CamperClick is not responsible for the actions, services, or conduct of Properties. Properties are independent third parties, and any issues, disputes, or claims you may have regarding a Property, its services, facilities, or staff must be resolved directly between you and the Property.

6.2 No Liability for Property Services

You agree that CamperClick shall not be liable for any damages, losses, or disputes arising from your interactions with Properties, including but not limited to:

• Quality of accommodations or facilities
• Accuracy of Property descriptions or amenities
• Property availability or overbooking
• Property cancellations or changes
• Personal injury or property damage occurring at Properties
• Disputes over charges, fees, or refunds with Properties
• Any other issues related to your stay or experience at a Property

6.3 Resolution Process

While we may assist in facilitating communication between you and a Property in the event of a dispute, we are under no obligation to do so, and any such assistance does not constitute an assumption of liability or responsibility for the dispute.

7. User Conduct

You agree not to:

• Use the platform for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Provide false, inaccurate, or misleading information
• Interfere with or disrupt the platform's operation or security
• Attempt to gain unauthorized access to our systems or user accounts
• Use automated tools to access or scrape the platform without permission
• Post or transmit harmful, offensive, or inappropriate content
• Impersonate any person or entity
• Engage in fraudulent activities or payment disputes in bad faith

8. Intellectual Property

All content on the CamperClick platform, including text, graphics, logos, images, software, and other materials, is the property of CamperClick or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on this content without our express written permission.

9. Disclaimers and Limitation of Liability

9.1 Service "As Is"

THE CAMPERCLICK PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMPERCLICK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use our services
• Any conduct or content of Properties or other users
• Unauthorized access to or alteration of your data
• Any other matter relating to our services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO CAMPERCLICK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless CamperClick, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of and access to the platform
• Your violation of these Terms
• Your violation of any third-party rights, including Property rights
• Your disputes with Properties
• Any misrepresentation made by you

11. Dispute Resolution and Arbitration

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

11.2 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of CamperClick shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in court. The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association.

11.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and CamperClick individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the platform will immediately cease.

You may terminate your account at any time by contacting us. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CamperClick regarding your use of our services.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

13.5 Force Majeure

CamperClick shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our platform prior to the effective date of the changes. Your continued use of CamperClick after the effective date constitutes acceptance of the modified Terms.
