Terms and Conditions for Property Managers

1. Acceptance of Terms

These Terms and Conditions for Property Managers ("Property Manager Terms") constitute a legally binding agreement between property owners, property managers, and their authorized team members (collectively "you," "Property Manager," or "Property") and CamperClick ("we," "our," or "us") governing your use of the CamperClick platform to list properties, manage bookings, and provide accommodation services.

By creating a property account, listing your property, or using our platform as a Property Manager, you agree to be bound by these Property Manager Terms, our general Terms and Conditions, and our Privacy Policy.

If you do not agree to these Terms, you may not list properties or use our services as a Property Manager.

2. Property Manager Accounts

2.1 Account Registration

To list properties on CamperClick, you must create a Property Manager account. You represent and warrant that:

  • You are at least 18 years old and have legal capacity to enter into binding agreements
  • All information you provide during registration is accurate, current, and complete
  • You have the legal authority to list and operate the property on our platform
  • You own or have proper authorization to manage the property you are listing

2.2 Team Members

You may add team members to your property account to help manage operations. By adding team members, you acknowledge and agree that:

  • You are responsible for the actions of all team members using your property account
  • Team members must comply with these Property Manager Terms
  • You will ensure team members are properly trained and authorized to perform their duties
  • You are liable for any violations or breaches committed by your team members
  • Each team member must have their own user account with appropriate permissions
  • You must immediately remove access for team members who are no longer authorized

2.3 Account Security

You are responsible for maintaining the security and confidentiality of all account credentials for yourself and your team members. You must notify us immediately of any unauthorized use or security breaches.

3. Property Listings

3.1 Listing Accuracy

You must ensure that all information in your property listing is accurate, complete, and up-to-date, including:

  • Property description and features
  • Accommodation types and availability
  • Amenities and facilities
  • Pricing, fees, and charges
  • Photos and media (which must accurately represent the property)
  • Cancellation and refund policies
  • Property rules and restrictions
  • Check-in and check-out procedures

You agree to update your listing immediately if any information changes. Misleading or inaccurate listings may result in account suspension or termination.

3.2 Property Standards

You represent and warrant that your property:

  • Complies with all applicable laws, regulations, and ordinances
  • Maintains all necessary licenses, permits, and insurance
  • Meets health and safety standards
  • Is accurately represented in photos and descriptions

4. Guest Information and Privacy

4.1 Receiving Guest Information

When guests make bookings through CamperClick, you will receive their personal information including:

  • Full name
  • Email address
  • Phone number
  • Time zone
  • Booking details and special requests
  • Payment information (as applicable)

4.2 Use of Guest Information

You agree that guest information provided through CamperClick may only be used for:

  • Fulfilling the guest's reservation and providing accommodation services
  • Communicating with the guest about their specific booking
  • Managing check-in, check-out, and on-site services
  • Addressing guest issues or requests during their stay
  • Complying with legal obligations

You agree NOT to:

  • Use guest information for marketing purposes without separate consent
  • Share guest information with unauthorized third parties
  • Contact guests to circumvent the CamperClick platform for future bookings
  • Sell, rent, or transfer guest information to others
  • Retain guest information longer than necessary for the booking and legal requirements

4.3 Data Protection Obligations

You must protect guest information with appropriate security measures and comply with all applicable data protection and privacy laws. You are responsible for ensuring that your team members also comply with these obligations.

5. Bookings and Reservations

5.1 Accepting Bookings

When you receive or create a booking through CamperClick, you enter into a direct contractual relationship with the guest. You agree to honor all confirmed reservations and provide the services as described in your listing.

5.2 Cancellations by Property

You may only cancel confirmed reservations in exceptional circumstances (e.g., property damage, safety concerns, force majeure). Frequent or unjustified cancellations may result in penalties, account suspension, or termination. If you cancel a reservation, you must:

  • Notify the guest and CamperClick immediately
  • Provide a full refund to the guest per your cancellation policy
  • Provide a valid reason for the cancellation

5.3 Guest Cancellations and Refunds

Guest cancellations and refunds are governed by the cancellation policy you set and display in your listing. By listing your property on CamperClick, you agree to:

  • Honor your stated cancellation policy for all guest cancellations
  • Process refunds in accordance with your cancellation policy
  • Apply your cancellation policy consistently and fairly to all guests
  • Not change the cancellation policy after a booking is confirmed
  • Process approved refunds in a timely manner

Guest refunds are calculated based on the cancellation policy that was in effect at the time of booking. You may not modify refund amounts or terms after a guest has made a reservation unless mutually agreed upon with the guest.

5.4 No-Shows and Early Departures

You may establish policies for no-shows and early departures, which must be clearly communicated in your listing. You agree to apply such policies fairly and consistently.

6. Payments and Fees

6.1 Service Fees

CamperClick charges service fees for facilitating bookings through our platform. Fee structures will be communicated to you and may include:

  • Commission on bookings (percentage-based or flat fee)
  • Payment processing fees
  • Additional service fees for premium features

We reserve the right to modify our fee structure with reasonable notice to you.

6.2 Payment Processing

Credit card and electronic payment processing is handled by Stripe, a third-party payment processor. By using CamperClick's payment processing features, you agree to:

  • Stripe's Terms of Service and payment processing agreement
  • Stripe's processing fees, which will be deducted from your payments
  • Provide accurate and complete information to Stripe for account verification
  • Comply with all applicable payment card industry (PCI) standards

You are also responsible for:

  • Maintaining valid payment accounts with Stripe or other integrated payment systems
  • Complying with all payment processor terms and conditions
  • Providing accurate banking and tax information
  • Paying applicable taxes on your earnings

CamperClick is not responsible for any fees, charges, or issues arising from your use of Stripe or other payment processors. Payment processing fees are separate from CamperClick service fees.

6.3 Refunds

You are responsible for processing refunds according to your cancellation policy and applicable laws. Guest refunds are based on the cancellation policy you have set for your property. You agree to:

  • Honor the refund amounts specified in your cancellation policy
  • Process approved refunds within a reasonable timeframe
  • Not withhold refunds that are due according to your cancellation policy

CamperClick may facilitate refunds through the platform but is not responsible for refund disputes between you and guests. Payment processing fees (such as Stripe fees) may not be refundable depending on the processor's policies.

6.4 Pricing and Charges

You have control over your pricing, including base rates, seasonal rates, and additional charges. By listing your property, you agree to honor the prices displayed in your listing at the time of booking, unless otherwise mutually agreed upon with the guest in writing.

You agree that:

  • All prices and fees must be clearly disclosed to guests before booking confirmation
  • You will honor the total price shown to the guest at the time they confirm their booking
  • You may not add undisclosed fees or charges after a booking is confirmed
  • You may not increase prices for confirmed reservations unless the guest agrees in writing
  • Price adjustments for modifications (e.g., adding guests, extending stay) must be clearly communicated and agreed upon

Failure to honor quoted prices may result in penalties, required refunds, account suspension, or termination.

7. Guest Relations and Disputes

7.1 Your Responsibility to Guests

You are solely responsible for all interactions with guests and for providing the services described in your listing. This includes:

  • Providing accommodations and services as advertised
  • Responding to guest inquiries in a timely manner
  • Addressing guest complaints or concerns
  • Maintaining property cleanliness and safety standards
  • Complying with accessibility requirements
  • Treating guests fairly and without discrimination

7.2 Resolving Disputes

You agree to make good faith efforts to resolve disputes directly with guests. CamperClick may provide mediation assistance but is not obligated to do so and is not responsible for the resolution of disputes between you and guests.

You acknowledge that disputes with guests, including claims for damages, injuries, or other issues, must be resolved between you and the guest. CamperClick is not liable for such disputes.

7.3 Non-Discrimination

You agree not to discriminate against guests based on race, color, religion, national origin, disability, sex, gender identity, sexual orientation, or any other protected characteristic under applicable law.

8. Property Manager Conduct

As a Property Manager, you agree not to:

  • Misrepresent your property or services
  • Manipulate reviews or ratings
  • Encourage guests to book outside the CamperClick platform
  • Circumvent CamperClick fees or payment processing
  • Use guest information for unauthorized purposes
  • Violate any applicable laws or regulations
  • Interfere with other properties' listings or operations
  • Create duplicate listings for the same accommodation
  • Engage in fraudulent activities or schemes

9. Insurance and Liability

9.1 Your Insurance Requirements

You are required to maintain appropriate insurance coverage for your property, including:

  • Property insurance
  • Liability insurance
  • Workers' compensation (if applicable)
  • Any other insurance required by applicable laws

9.2 Liability for Guest Issues

You are solely liable for:

  • Personal injuries or property damage occurring at your property
  • Loss or theft of guest belongings
  • Any claims arising from your services or accommodations
  • Actions of your employees, contractors, or team members
  • Compliance with health, safety, and building codes

9.3 CamperClick's Limited Role

CamperClick acts solely as a platform connecting you with potential guests. We do not own, manage, or control your property and are not responsible for any aspect of your property operations or guest experiences.

10. Intellectual Property

10.1 Your Content

You retain ownership of all content you provide (photos, descriptions, etc.). By posting content on CamperClick, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for the purpose of operating and promoting our platform.

10.2 Content Standards

All content you provide must:

  • Be accurate and not misleading
  • Not infringe on third-party intellectual property rights
  • Not contain offensive, inappropriate, or illegal material
  • Comply with our content guidelines

11. Reviews and Ratings

Guests may leave reviews and ratings for your property. You agree that:

  • Reviews are the opinions of guests and not statements of fact by CamperClick
  • You will not attempt to manipulate or influence reviews improperly
  • You may respond professionally to reviews
  • CamperClick may remove reviews that violate our policies
  • Reviews may impact your property's visibility on our platform

12. Suspension and Termination

12.1 By CamperClick

We may suspend or terminate your account immediately if you:

  • Violate these Property Manager Terms or our general Terms and Conditions
  • Engage in fraudulent or illegal activities
  • Receive excessive guest complaints
  • Frequently cancel confirmed bookings
  • Provide false or misleading information
  • Fail to maintain required insurance or licenses

12.2 By You

You may terminate your account at any time, subject to fulfilling all existing reservations and obligations. You must provide reasonable notice of account closure.

12.3 Effect of Termination

Upon termination, you must:

  • Fulfill all existing confirmed reservations
  • Settle any outstanding payments or fees
  • Return any guest information in accordance with data protection laws

13. Indemnification

You agree to defend, indemnify, and hold harmless CamperClick, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use of the platform as a Property Manager
  • Your violation of these Property Manager Terms
  • Your property operations and services provided to guests
  • Any injury, damage, or loss occurring at your property
  • Actions of your team members, employees, or contractors
  • Your violation of applicable laws or regulations
  • Disputes with guests
  • Infringement of third-party intellectual property rights
  • Your misuse of guest information

14. Disclaimers and Limitation of Liability

14.1 Platform "As Is"

THE CAMPERCLICK PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee continuous availability, error-free operation, or any specific booking results.

14.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMPERCLICK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR YOUR RELATIONSHIP WITH GUESTS.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE FEES YOU PAID TO CAMPERCLICK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

15. Tax Obligations

You are solely responsible for:

  • Determining which taxes apply to your property and bookings
  • Collecting and remitting all applicable taxes (income, occupancy, sales, VAT, etc.)
  • Providing accurate tax information to CamperClick and tax authorities
  • Maintaining proper tax records and documentation

CamperClick may collect and remit certain taxes on your behalf in some jurisdictions, but you remain ultimately responsible for tax compliance.

16. Legal Compliance

You represent and warrant that you will comply with all applicable laws, regulations, and ordinances, including:

  • Local zoning and short-term rental regulations
  • Health and safety codes
  • Building and fire safety requirements
  • Accessibility laws (e.g., ADA compliance)
  • Employment and labor laws
  • Data protection and privacy laws
  • Anti-discrimination laws
  • Licensing and permit requirements

You are solely responsible for understanding and complying with all legal requirements in your jurisdiction.

17. General Provisions

17.1 Relationship

CamperClick and Property Managers are independent contractors. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.

17.2 Entire Agreement

These Property Manager Terms, together with our general Terms and Conditions and Privacy Policy, constitute the entire agreement between you and CamperClick regarding your use of the platform as a Property Manager.

17.3 Modifications

We may modify these Property Manager Terms at any time. We will notify you of material changes, and your continued use of the platform constitutes acceptance of the modified terms.

17.4 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
